Did you know that if a husband and wife with a special needs child die...and their child inherits their estate that the child is no longer elligible for any government services? The law says that if the special needs child has assetts in access of $2,000. they are not elligibe for any help from the government. Does that sound f----d up to any one else besides me?

No. i am just stating a fact i found out about the law that i think is a little less than fair. folks who are rich and educated put everything in a trust and get around the law...but those folks who don’t know about this little trick are screwed....and it doesn’t seem fair to the kids to me.

A retarded adult, or an adult who is otherwise permanently disabled, can’t possibly care for themselves forever. The parents realize this, and usually have power of attorney over them. This means the handicapped adult remains a child forever in a sense. For instance, they can’t sign contracts or bank checks, so con artists can’t rip them off.
Parents should make out wills early on, and pay particular attention to their handicapped childrens’ living arrangements in the future. The house could be sold, for instance, and the child could live in an assisted living facility in exchange for their government aid checks, with the inheretance controlled by a trusted friend or family member who gains power of attorney.

right, but my point is....most folks who have a special needs child, and there are hundreds of diagnosis that are special needs that are not retarded, don’t know that if they both died and let’s say they were poor and left the kid a $5,000. house ....the kid gets no help from the government. i would venture to say that most parents under age 50 of special needs children are totally unprepared for the government to screw their children......

yes i agree it is wrong, i use to have a form showing how you could leave it all to your speical need child, without them losing the goverment help they were getting , but that got lost if a fire. If i can get it again, i will share it on here, it is a legal matter, and how to get around it.

Totally wrong, all the people in all the governments are idiots, they’re narrow-minded assholes who don’t apply their laws to every-day life, or apply any compassion to them.
Definatley not fair for the child though, even if they did get a fair amount of money, they wouldn’t have enought to compensate their loss (seeing as they would have obviously been an extreme dependent), nevermind the fact that they most likely would not have enough for their medical treatments for very long (and depending on their disability, their career options and income are both limited, which means limited money).
It’s like the government doesn’t even think before it declares something as law, no governments do, its BS.
(btw, Pentium.... marijuana (THC and marinol) is a known cure for tourettes, in case you didn’t know)

Muse, feel free to swear without need to "blank" it out. I understand your reasons for blanking it out, but most of us have seen the word before.
I’m sure the Government gives the handicapped kid more than $2,000.00, making that completely FUCKED UP. That is absolutely ridiculous. Perhaps you should try and convince Arnold (if you see him in Hollywood!) to try and stop it. Then again, he’s a republican, so good luck convincing him to do something nice!

true.....well, like i said the folks in the know just create trust funds for their kids and keep everything out of their names....but i just think it’s ashamed that poor folks or single moms who don’t have good attorney connections aren’t aware of this law and THEIR kids are the ones that get screwed......

who gives a shit about the handicapped? if they didn’t live in America they’d be shot twice in the head. it’s called "natural selection". but no, the US eats up the tax payers dollars to help them... it’d be cheaper to just kill them. in fact, abortions are legal at any time for children missing the 14th chromosome (the cause of mental retardation)
