They can’t sue you for listening. That would only be if you illegally downloaded the MP3.
Even if you did, I’m sure they can’t do much. The guy is dead, so who would they be able to give the royalties to if they sued you and won in court? There’s an even deeper thought.

a. I was being sarcastic
b. I’m in Australia, so there’s much less chance they’re gonna sue me
c. The RIAA is an american organisation, this recording is French and was probably made before copyright laws
d. By downloading the raw MP3 not embedded in a flash, that’s technically downloading the actual song
e. If they won the lawsuit, they would keep the money just like everyone else they have sued

Music becomes public domain after 70 years after the artist dies..
Do what you like with the mp3.
I doubt copyright was even thought of.
