So SWIM got caught cheating on a test in school and now has to go see the dean. Now technically SWIM was not cheating, but will give you all the facts on the table:
During the exam, SWIM had alot of random hw and scratch papers/study materials underneath his feet that was brought to the testing room since SWIM didn’t carry a backpack around. SWIM had a packet of about 8 pages with very small print on it for reference during the test, faced upside down. The teacher comes over and collects the papers underneath SWIM’s feet and makes an announcement that everyone put away excess papers. Now later, the teacher comes over and asks SWIM to clear the desk and then takes away the reference packet.
Now how could SWIM mount a believable or the best defense possible given these circumstances. SWIM could say that SWIM legitimately forgot to put away the packet of papers underneath the desk along with the rest of the stack since there was so many present at the time. Also, since SWIM did not get a high grade or a low grade, could SWIM use that as evidence that no cheating took place? The reference packet that SWIM had was all the hw questions and the answer solutions to them. If SWIM had printed them out normally, it would’ve been roughly 50 pages or so. That is why SWIM printed them out in such a small and compact format. As for when the teacher made the announcement, SWIM could say that SWIM was too focused on the test and unconsciously blocked it out. There are alot of gaps in SWIM’s defense that could easily be exploited. Any ideas?

What is the point of SWIM? You have already been caught. Even then, it doesn’t protect you from anything.

what malinko said, if they have no proof, then what? they cant do anything, if u were cheating and got an epic grade then yes thats proof but if it was an ok grade then ask them to prove it. if u were cheating u would obviously have an epic grade

srry for the second post i forgot to add this example.
like at school my VP (vice principal) tryed to suspend me for 20 days on 7 fucking charges, he only had proof on 2 of those and it wasnt even really proof 1 kid said i did something, so i was like "k u only got 2 charges, so prove the other ones", and he couldnt so i bitched him out saying "so you tryed to pin other charges on me that u have no proof of to get me in more shit? just cuz one person said i did something doesnt mean i did, if u have video evidence then yes suspend me but until then leave me alone." then hes like "dont be a smart ass, ill call ur parents", i said "k ya good call them i wonna talk to them about this that ur trying to suspend me for no reason", then he told me to get out of his office :D, yay happy day

Teacher tried to pull that on me too. She asked me if I wanted her to call my parents and tell them what a terrible kid I was being. I got up dialed the phone, turned around and held the phone out for her and said "Here, I did half the work, I suppose you can handle it now." Haha, I’m pretty sure she got fired a couple of years after I left because the lazy bitch never came in on Mondays.

Good idea, but I doubt it will work. Its the teacher’s word over the student’s. Ask them if SWIM can take the test over. Thats the only way I see it working out. I mean if I was in this situation, I would probably ask to take the test over, this time without anything around me.

The thing is, it’s been like over a month since this incident happened, and SWIM doesn’t know how much information SWIM still has retained. The only evidence they have is the hw packet that was confiscated and probably along with the other scratch pieces of paper. SWIM is probably going to just tell them that SWIM neglected to put the packet underneath the desk, as SWIM wasn’t caught redhanded

Offer to retake the test without any notes present, or to take a second test on the same information.
